1. Acceptance of Terms
By accessing or using the Spectrum Foodservices website and services, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.
2. Business Accounts
Our services are intended for business use only. By creating an account, you represent that:
- You are authorized to bind your business to these terms
- All information provided is accurate and current
- You will maintain the security of your account credentials
- You will notify us of any unauthorized use of your account
3. Product Information & Pricing
We strive to provide accurate product information and pricing. However:
- Prices are subject to change without notice
- All prices are in USD unless otherwise specified
- Taxes and shipping costs are additional
- We reserve the right to correct any pricing errors
- Product specifications may vary slightly from descriptions
4. Orders & Payment
Order Acceptance
All orders are subject to acceptance by Spectrum Foodservices. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or credit issues.
Payment Terms
- Payment is due upon order placement unless credit terms are established
- We accept major credit cards, ACH transfers, and approved credit accounts
- Net 30 terms available for qualified businesses
- Late payments subject to 1.5% monthly finance charge
5. Shipping & Delivery
Products are shipped directly from the manufacturer to your location. Risk of loss passes to buyer upon delivery.
- Migali products include FREE freight shipping
- BK Resources and other products require freight quote (provided at checkout)
- Delivery times are manufacturer estimates and may vary
- Inspect all shipments and note any damage on the carrier's delivery receipt
- Report shipping damage to Spectrum within 48 hours
6. Return Policy
Returns accepted within 30 days of delivery on unused items in original condition:
- RMA (Return Merchandise Authorization) required before returning any items
- Must be in original packaging and resalable condition
- 25% restocking fee applies to all returns
- Customer responsible for return shipping costs to manufacturer's warehouse
- Custom-fabricated items (cut-to-size tables, custom sinks, etc.) are non-returnable
Cancellations
Orders may be cancelled before manufacturer shipment. Special order and custom items cannot be cancelled once manufacturer begins production. Contact us immediately if you need to cancel an order.
7. Warranties
Equipment warranties are provided by the manufacturer (Migali, BK Resources, etc.). Spectrum Foodservice Solutions is an authorized reseller and facilitates warranty claims but does not provide warranties beyond those offered by manufacturers. Please refer to our warranty page for specific coverage details by brand.
8. Limitation of Liability
In no event shall Spectrum Foodservices be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our products. Our total liability shall not exceed the purchase price of the products.
9. Indemnification
You agree to indemnify and hold harmless Spectrum Foodservices from any claims arising from your use of our products or violation of these terms.
10. Governing Law
These terms shall be governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of Rutherford County, Tennessee.
11. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.
